Coffee Artista – Terms & Conditions

1. Acceptance of These Terms
By visiting, ordering from, or otherwise interacting with Coffee Artista Café (“Coffee Artista,” “we,” “us,” or “our”), including our physical location(s), website(s), mobile applications, Wi‑Fi network, online ordering platforms, third‑party delivery partners, or social‑media channels (collectively, the “Services”), you (the “Customer,” “you,” or “your”) agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree, please do not use the Services. We may update these Terms at any time; continued use after changes are posted constitutes acceptance of the revised Terms.
2. Eligibility & Customer Conduct
a. You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order, make a payment, or enroll in marketing programs without the consent of a parent or legal guardian.
b. You agree to act respectfully toward staff and other patrons and to comply with all posted house rules and instructions. We reserve the right to refuse service or remove anyone for disruptive or unlawful conduct.
3. Menu Information & Dietary / Allergy Disclaimer
a. We endeavor to identify common allergens (e.g., milk, eggs, wheat, soy, peanuts, tree nuts, fish, shellfish, and sesame) in menu descriptions; however, all food and beverages are prepared in shared facilities where cross‑contact may occur. We cannot guarantee that any item is completely free of allergens.
b. Customers with food allergies or dietary restrictions should inform staff before ordering and exercise their own judgment.
c. Nutrition facts are estimates and are provided for informational purposes only; actual values may vary.
4. Pricing, Taxes & Gratuities
a. All prices are listed in U.S. Dollars (USD) and are subject to applicable sales tax pursuant to Tex. Tax Code §151.
b. Suggested gratuities are optional and are not sales‑taxable under Texas Comptroller guidance.
c. We reserve the right to change menu items and prices at any time without prior notice.
5. Orders & Payment
5.1 In‑Store Purchases
We accept cash, major credit/debit cards, and contactless payments. All card transactions are processed through PCI DSS‑compliant providers; Coffee Artista does not store full card numbers.
5.2 Phone or Online Orders
Orders placed by phone, our website, or third‑party apps require pre‑payment. You are responsible for providing accurate contact information and promptly collecting your order.
5.3 Gift Cards & Stored Value
Coffee Artista gift cards do not expire and are redeemable only for eligible Café purchases. Lost or stolen cards will not be replaced except where required by law. Gift cards are not refundable or redeemable for cash except as mandated by Tex. Bus. & Com. Code §72.101.
6. Refunds, Returns & Cancellation Policy
6.1 Food & Beverage Satisfaction
If you are not satisfied with a food or beverage item, please notify us at the time of service. We may, at our sole discretion, remake the item or issue a refund of the purchase price (excluding gratuities).
6.2 Merchandise & Retail Items
Unused merchandise (e.g., sealed coffee beans, branded mugs) may be returned with receipt within 14 days for exchange or refund. Clearance items, perishable goods, and opened packages are final sale.
6.3 Event Space & Catering Deposits
A signed agreement and non‑refundable deposit (typically 25%) are required to hold event dates. Cancellations within 7 days of the event forfeit the deposit. Rescheduling is subject to availability and may incur additional fees.
7. Promotions, Discounts & Marketing Communications
7.1 Promotional Offers
Coupons, promo codes, and loyalty rewards have no cash value, are non‑transferable, and may not be combined unless expressly stated. We reserve the right to modify or cancel promotions at any time.
7.2 Loyalty Programs
Participation is voluntary. Points or credits accrued have no monetary value and may be adjusted or terminated upon 30 days’ notice.
7.3 Text & Email Marketing
By opting in, you consent to receive autodialed marketing messages at the phone number or email you provide, pursuant to the Telephone Consumer Protection Act (47 U.S.C. §227) and Tex. Bus. & Com. Code §305. You may withdraw consent at any time by replying STOP (SMS) or unsubscribing (email). Message and data rates may apply.
7.4 User‑Generated Content License
If you tag or submit photos, reviews, or other content featuring Coffee Artista, you grant us a non‑exclusive, royalty‑free, worldwide, perpetual license to use, display, and distribute such content for promotional purposes, subject to any platform‑specific terms.
8. Intellectual Property
All branding, logos, menu designs, photographs, and website content are owned by Coffee Artista or its licensors and are protected by U.S. and international copyright, trademark, and trade‑dress laws. Unauthorized use is prohibited.
9. Wi‑Fi & Digital Services
Our complimentary Wi‑Fi is provided “as is” without warranties. You agree to use it lawfully and not to engage in activities that infringe intellectual property or violate privacy, security, or criminal laws. We may monitor usage and block or limit access at our discretion.
10. Privacy

11. Accessibility
Coffee Artista strives to provide equal access to our facilities and digital content in compliance with the Americans with Disabilities Act (ADA) and Texas Accessibility Standards.
12. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
13. Limitation of Liability
To the maximum extent allowed by Tex. Civ. Prac. & Rem. Code §41, Coffee Artista shall not be liable for indirect, incidental, or consequential damages arising out of or related to the Services. Our total liability shall not exceed the amount you paid to us for the applicable transaction.
14. Indemnification
You agree to indemnify and hold Coffee Artista harmless from any claims, damages, or expenses (including attorneys’ fees) arising out of your breach of these Terms or misuse of the Services.
15. Compliance With Laws & Regulatory Disclosures
We comply with all applicable federal, state, and local laws, including U.S. Food & Drug Administration (FDA) food‑safety regulations, Texas Food Establishment Rules (25 TAC §228), the Fair Credit Billing Act (15 U.S.C. §1666), and relevant consumer‑protection statutes.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas without regard to conflict‑of‑laws principles. Any dispute shall be resolved through good‑faith negotiations; if unresolved, either party may seek relief in the state or federal courts located in Hidalgo County, Texas, except that claims within small‑claims jurisdiction may be filed there. The parties waive the right to a jury trial.
17. Modifications
We may update these Terms by posting the revised version with a new “Effective Date.” Material changes will be announced via in‑store signage or electronic notice at least 14 days before they take effect.
18. Severability
If any provision is found unenforceable, the remaining provisions will remain in full force, and an enforceable term will be substituted that most closely reflects the original intent.
